By accessing or using Buyer Be Aware ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Buyer Be Aware provides property intelligence reports that aggregate publicly available data from government agencies, county records, and licensed data providers. Reports include property details, flood risk, crime statistics, school proximity, sex offender proximity, ownership history, and related information for residential properties in the United States. An optional recurring "Property Monitoring" subscription is available; see Section 6.
Buyer Be Aware is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA).
You may not use our reports for any purpose covered by the FCRA, including but not limited to:
Reports are provided for personal, informational use only to assist homebuyers in making informed property purchase decisions.
While we strive to provide accurate information, all data is sourced from third-party providers and public records that may contain errors, omissions, or delays. Data may not reflect the most current information available. Reports are provided "as is" without warranty of any kind.
Insurance cost estimates, AI-generated analysis, and risk assessments are approximations only and should not be relied upon as professional advice. Always consult qualified professionals (inspectors, attorneys, insurance agents) before making purchase decisions.
Reports are one-time purchases per address. Payments are processed securely through Stripe. If a report fails to generate due to a technical error on our end, we will issue a full refund. Successfully generated reports are non-refundable due to the cost of data retrieval.
Property Monitoring is an optional recurring subscription ($4.99/month per property at the time of writing). When you subscribe, we periodically re-check the public records for the watched property and send an email when a material change is detected. Alerts are throttled to at most one per property per week, even if multiple changes are detected within that window.
You may cancel at any time via the "Manage billing" link on the Watches page (which opens the Stripe Customer Portal). Cancellation stops billing at the end of the current billing period; we do not pro-rate refunds for the remainder of the current period. We do not store or process credit card information ourselves; all billing is handled by Stripe.
Monitoring is a convenience service, not a guarantee. Public records can change without an alert firing if the change is not reflected in the underlying data source we re-check, or if the source experiences a delay. Always verify against the original source before acting on an alert.
You are responsible for maintaining the security of your account credentials. You may not share your account or use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these terms.
The Service, including its design, code, and branding, is owned by Buyer Be Aware. Report data is sourced from third parties and subject to their respective terms. You may use generated reports for personal purposes but may not resell or redistribute them.
To the maximum extent permitted by law, Buyer Be Aware shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages resulting from reliance on report data, property purchase decisions, or data inaccuracies.
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via the website.
